In exercise of the right of access to public information, the SEPI, of the Ministry of Finance, was requested to access various information on the public support received by the company Volotea from the Fund to Support the Solvency of Strategic Companies, as well as the loan signed with it.
The requested body refused access because it considered that there was a specific legal regime for access to information that determines the confidentiality of the information requested; and that, even if the LTAIBG were to be understood as applicable, it would be affected by the limits of articles 14.1.h), (i) and (k).
Once the complaint has been filed, the Transparency Council, referring to the existence of several previous pronouncements on substantially identical matters, considers it partially, on the understanding that the existence of a specific reservation of confidentiality does not automatically or absolutely exclude access to that part of the information contained in the resolutions and agreements of the Management Board of the Aid Fund that is not confidential or that does not affect the commercial interests of the companies benefiting from the aid.
