The Transparency Committee

Members of the Committee on Transparency and Good Governance

The Council of Transparency and Good Governance is structured in a Presidency, on which several governing bodies depend, and in the Committee on Transparency and Good Governance.

The Commission is a collegiate consultative body chaired by the person holding the Presidency of the Council for Transparency and Good Governance, and in which various State bodies and institutions are represented. Approving the annual report of the Council, proposing the adoption of recommendations, guidelines or guidelines on transparency and the right of access to public information and reporting on State regulatory projects related to these matters are some of its functions.

The Commission is regulated in the article 36 Law 19/2013, of 9 December, on transparency, access to public information and good governance Article 15 et seq. of Royal Decree 615/2024, of 2 July, approving the Statute of the Council of Transparency and Good Governance.

La Comisión está integrada por la persona que ostenta la Presidencia del Consejo de Transparencia y Buen Gobierno, que la preside, y por 7 vocalías. Ejerce la Secretaría de la Comisión, con voz pero sin voto, la persona titular de la Subdirección General de Transparencia y Buen Gobierno del Consejo.

The Committee on Transparency and Good Governance is responsible for carrying out the following functions:(Article 15 of Royal Decree 615/2024 of 2 July approving the Statute of the Council of Transparency and Good Governance)

  • Advise on transparency, access to public information and good governance.
  • Mandatory reporting of normative projects of a state nature that develop Law 19/2013, of 9 December, or that are related to its purpose.
  • Approve the annual report analysing the degree of application of Law 19/2013, of 9 December, and provide detailed information on the fulfilment of the obligations contained therein.
  • Propose to the President the adoption of recommendations, guidelines or guides of good practices in the field of transparency, access to public information and good governance.
  • Promote training and awareness activities for a better knowledge of the subjects regulated by Law 19/2013, of 9 December.
  • To convene, at least annually, the bodies of a similar nature of the autonomous communities for the purpose of institutional cooperation.
  • Articular mecanismos de colaboración con órganos de naturaleza análoga a nivel autonómico o internacional.
  • Issue a report on the issues submitted to it by the President.
  • Approve the Internal Operating Regulations of the Council of Transparency and Good Governance.

The law establishes that the member status of the Commission of the Council of Transparency and Good Governance it shall not require full-time nor entitle to remuneration. The president will receive the established remuneration for his/her position.

The members of the Committee on Transparency and Good Governance will be proposed as follows: (Article 17 of Royal Decree 615/2024 of 2 July approving the Statute of the Council of Transparency and Good Governance):

a) The Congress of Deputies shall propose a Deputy or Deputy.

(b) The Senate shall propose a Senator.

(c) The Court of Auditors shall propose a Counsellor of the Court of Auditors.

(d) The Ombudsman shall propose a representative.

e) The Spanish Data Protection Agency will propose a representative.

(f) The Ministry for Digital and Civil Service Transformation shall propose a representative of the State Secretariat for Civil Service.

(g) The Independent Fiscal Responsibility Authority shall propose a representative.

The proposals will be submitted to the Government through the Minister of Digital Transformation and the Civil Service.

The members of the Transparency and Good Governance Commission shall be appointed and dismissed by agreement of the Government, respecting the principle of a balanced presence of women and men.

The members of the Commission shall hold office for five years, and their term of office may be extended for a period of the same duration. (Article 18 of the Statute of the Council for Transparency and Good Governance)

If any vacancy occurs in the vocalías before the expiration of the mandate, it must be filled within the following month, and for the time remaining to complete the mandate.

Article 19 of the Statute of the Council on Transparency and Good Governance

Before the end of the term of office of the Commission’s spokespersons, the Minister for Digital Transformation and Public Service will require the institutions and bodies to communicate, within the following month, the identity of the persons proposed for a new term of office in the Commission.

The Government shall appoint the persons nominated as members of the Commission, who shall take office on the same date as the expiry of the previous term of office.

Article 20 of the Statute of the Council on Transparency and Good Governance

The committee will adopt its agreements in plenary session.

The commission will meet at least once a quarter. It shall also meet at the invitation of the Presidency or at the request of the majority of its members.

The committee shall be validly constituted, on first call, if the Presidency, the Secretariat and half of the appointed spokespersons are present and, on second call, if the Presidency, the Secretariat and one third of the appointed spokespersons are present.

The commission will be able to meet and adopt agreements both in person and by electronic means.
