Extremadura and Melilla have renewed their respective agreements with the Transparency Council by which they attribute to the latter the exercise of jurisdiction for the resolution of the claims provided for in article 24 of Law 19/2013, of 9 December, on Transparency, Access to Public Information (LTAIBG).
This competence covers the claims filed against the resolutions on requests for access to public information issued by the Autonomous Administration and the local entities of its territorial scope, as well as by the entities of its public sectors.
The new agreement of the Council of Transparency with Extremadura has been published in the BOE on December 14, while the agreement with the Autonomous City of Melilla It was published on November 20th. The Council has been resolving the public information access claims affecting these two territories since 2016.
The Council has an agreement with 7 autonomous communities
The fourth additional provision of the LTAIBG establishes that the resolution of claims on the right of access to information shall be the responsibility of the independent body determined by the autonomous communities in the cases of resolutions issued by the autonomous administrations and their public sector, and by the local entities within their territorial scope. The Law provides for the possibility for the autonomous communities to assign to the Council of Transparency and Good Governance the competence for the resolution of these claims through the conclusion of the corresponding agreement.
Currently, there are seven autonomous communities and cities whose complaints regarding access to public information are heard by this Council: Principality of Asturias, Balearic Islands, Cantabria, Ceuta, Extremadura, La Rioja and Melilla. These autonomous communities represent 9% of the population of Spain.
In 2023, the Council of Transparency and Good Governance resolved a total of 1,090 claims at regional and local level, which was 66.4% more than the previous year. A total of 120 claims were in the area of Extremadura and 31 in the area of Melilla.
