Historical record of complaints to the Council: 3,021 between January and September, more than in all 2025

Of the complaints received between January and September 2026, 7 out of 10 (2,088 files) have been filed with government ministries and public sector entities. The rest (933 claims) relate to requests for information submitted to administrations, bodies and entities of the autonomous and local area of those autonomous communities that, by agreement, have entrusted the Council with the exercise of this competence (Principality of Asturias, Balearic Islands, Cantabria, Extremadura, La Rioja, Ceuta and Melilla).

The data show an acceleration of the growth of the claims that the citizens present to the CTBG to guarantee their right of access to public information. In 2024, 1,973 claims were filed, almost the same number as in 2023 (4.6% more), but in 2025 the increase compared to the previous year was 40%. But the trend has clearly intensified in 2026. Between July and September alone, 1,263 new claims were registered, 27% more than in the previous quarter and twice as many as in the same period of 2025.

"The figures show a bittersweet reality: on the one hand, they reflect that citizens are increasingly aware of their right to know and exercise it, which is undoubtedly very positive; but on the other hand, the guarantee function performed by the Council cannot be sustained indefinitely with the current means," says the president of the CTBG, Concepción Campos Acuña. "In addition to the quantitative increase, we must take into account the increasing complexity of the issues that reach the Council. Guaranteeing the right of access on time and with quality requires an endowment of resources in accordance with this reality," adds the president.

However, the budget of the independent authority has remained unchanged since 2023, with 3.38 million euros per year. In addition, the Council’s staff, made up of around thirty public employees, has hardly changed since then.

In addition to resolving complaints, the Council performs other essential functions to ensure public transparency. In compliance with the powers established by Law 19/2013, of 9 December, on transparency, access to public information and good governance (LTAIBG), the agency also evaluates the fulfilment of the obligations of active publicity by public and private entities, elaborates interpretative criteria and recommendations to facilitate the application of the norm, attends consultations formulated by the subjects obligated and promotes training and awareness activities aimed at public employees.

In 2025 alone, the Council resolved 2,234 complaints and evaluated nearly 400 entities in terms of active advertising, in addition to performing the other functions attributed to it as an independent transparency authority.
