A citizen asked the Health Department of the Principality of Asturias for information on the results of the sanitary and/or hygienic inspections carried out in bars, restaurants, cafeterias, etc., and other catering or food facilities in the cities of Gijón, Oviedo, Avilés and Siero between January 2016 and June 2019.
After the deadline to resolve without obtaining a response, the interested party presents a complaint to the Council of Transparency and Good Governance in February 2020.
The Transparency Council estimates the complaint as it considers that this is public information and that the personal data protection limit, indicated by the administration, of Article 15 of the Law 19/2013, of 9 December, on transparency, access to public information and good governance, when the publication of the sanctions is protected by the Law 17/2011, of 5 July, on food security and nutrition.
In response to the resolution issued by the Council, the Principality of Asturias lodged an administrative appeal, which entered the Council on 23 December 2020.
