On July 31, 2024, an individual asked the Ministry of Town Planning, Town Planning, Housing and Citizens’ Rights for access to the file(s) of town planning discipline, coasts and any other type of town planning related to a building under construction and paralysed and affected by the Coastal Protection Servitude, which is estimated by the Ministry of Town Planning, Housing and Citizens’ Rights. Faced with such a resolution, a claim is filed by a third party claiming that the applicant has no legitimate interest.
The Council dismisses the claim since, in accordance with article 17.37 of the LTAIBG, the applicant for public information is not obliged to substantiate his request for access, and therefore the argument concerning the absence of interest adduced by the claimant cannot be accepted. Likewise, there can be no objection to affecting the right to the protection of personal data by the application of Article 15.4 of the LTAIBG, when granting the duly anonymized information,
In response to the resolution issued by the CTBG, the claimant lodged an administrative appeal, which entered the Council on September 16, 2025.
