SUMMARY

Access Info Europe submitted a request for access to the Ministry of Agriculture, Fisheries and Food to obtain information on the list of beneficiaries of EAGF and EAFRD funds between the years 2012-2017.

The Ministry denied the information on the grounds that there is a specific regulation on access to the information contained in Regulation (EU) No 1306/2013 of the European Parliament and of the Council of 17 December on the financing, management and monitoring of the common agricultural policy and in Commission Implementing Regulation (EU) No 908/2014 of 6 August 2014.

The Council of Transparency and Good Governance considered the complaint, as the first additional provision, paragraph 2, of the Transparency Act did not apply to the present case, since this European regulation does not contain a genuine specific procedure for access to information. Nor does it affect the right to protection of personal data, since these funds share the nature of the subsidies and therefore their beneficiaries must be made public, ex article 8.1 c) of the Transparency Act.
