In exercise of the right of access to public information, RED ELÉCTRICA DE ESPAÑA, S.A.U was requested to access the identification data, charges, level of responsibility and chain of command of the participants in the Operation of the System on the morning of 28.04.2025 and, in particular, at 12:33 hours, when the energy zero occurred, as well as the chief technical officer of the General Directorate of Operation of REE.

The entity to which the information was requested did not respond to the request.

The Council disallows the claim in accordance with the provisions of article 2.1.g) Law 19/2013, of 9 December, on transparency, access to public information and good governance, which establishes that its provisions will apply to "[l]commercial companies in whose share capital the direct or indirect participation of the entities provided for in this article is greater than 50 per 100». In this case, the participation of the public sector in REDEIA, through the SEPI, is 20%, so the LTAIBG does not apply to it and, consequently, this Council lacks the competence to resolve the claim presented.
