Appeal of the Unified Police Union by resolution concerning the award of medals to Police Merit with red badge
SUMMARY
A union asked the Ministry of the Interior for information on the content of the candidates' professional history to receive the Police Order of Merit with red badge. Access was denied by the aforementioned Department when it considered that there would be a violation of the right to protection of personal data.
Submitted to this Council for Transparency and Good Governance, this was dismissed because it considered that, according to the regulations governing this type of distinction, they are addressed to persons who meet the conditions specially provided for it and who are mostly officials of the National Police Force whose identity and history (which was the subject of the request) if known could jeopardize their personal integrity or the operations they are carrying out or have been carried out and which motivated the award of the decoration. The CTBG also drew attention to the repeated jurisprudence on this issue, which supported the discretion of the Ministry of the Interior in such concessions.
The union, in disagreement with the criterion maintained by the CTBG, has filed a contentious-administrative appeal against the aforementioned resolution.
The ruling of the Central Administrative Court and the ruling on appeal are favourable to providing the information.
