SUMMARY

The Personnel Board submitted a request for access to the information addressed to the Special Delegation of the State Tax Administration Agency (AEAT) in Valencia, which aimed to know the distributions of the productivity exchanges, based on objectives and by disaggregation of functional groups.

The same Personnel Board filed a Complaint with the Council of Transparency and Good Governance (CTBG) when its request was denied by the Administration, due to administrative silence.

The CTBG considered the Claim because it considered that access to information for Personnel Delegates and Personnel Boards is governed by Law 19/2013, of December 9, on Transparency, Access to Public Information and Good Governance and not only by the specific regulation contained in the Basic Statute of the Public Employee, which only indicates, in general, that such workers' representatives have as one of their functions to receive information on personnel policy, as well as on the evolution of remuneration, employment and improvement of performance.
