Appeal of Penitentiary Institutions against the decision of the CTBG that considered a claim for denial of the right of access.
SUMMARY
A citizen submitted a request for access to information addressed to the General Secretariat of Penitentiary Institutions of the Ministry of the Interior and the Government Delegation in Andalusia, which aimed to know the number of officials of the Penitentiary Center of Seville who enjoyed special permits for births or adoption of children.
The Ministry of the Interior forwarded the application to the Ministry of Finance and Territorial Administrations, as it understood that the latter was competent, informing the applicant, who filed a claim with the Council of Transparency and Good Government.
At the allegation stage, the Ministry of Finance and Territorial Administrations stated that they did not have the information and understood that the competence was that of the Ministry of the Interior.
The Transparency Council considered the complaint and stated that the General Secretariat of Penitentiary Institutions of the Ministry of the Interior is responsible, since the specific data requested refers to the management of human resources of a Penitentiary Centre.
