Appeal for access to the resolutions of the Regional Economic Administrative Court of Madrid (TEAR)
SUMMARY
The TEAR of Madrid received a request for access to information related to access to all the resolutions issued by that body, since 2004, including individual votes. As in a previous case handled by this Transparency Council, the request did not receive a response and, when the corresponding complaint was filed, it was rejected on the understanding that the obligation to publish information of legal relevance insofar as it implied an interpretation of the law could be considered fulfilled with the publication of the most relevant resolutions or that they implied a change or novelty with respect to the previous situation, for example, because it contained an interpretation that differed in some sense from the previous ones, laying down new criteria, or that took into account new elements not present so far.
