ABSTRACT

A citizen submitted a request for access to information addressed to the Ministry of Employment and Social Security to access information related to work accidents with leave registered in the Delt@ system, in 2016.

The Ministry denied access, considering that this information violated statistical secrecy and the right to protection of personal data.

When a complaint was filed, the Council for Transparency and Good Governance partially estimated it, since the data were provided in 2004 for the preparation of a report whose link is included in the request for information, which prevents it from being said that there is a violation of statistical confidentiality. Likewise, the Law allows the subsequent control of any possible incorrect treatment of the information, including the transfer to third parties or the identification of the holders of the information, even if the applicant does not have the status of researcher.
