SUMMARY

An association of consumers submitted a request for access to information addressed to the Ministry to access the content of clinical trials with certain medicines, safeguarding the rights that affect the privacy of patients, commercial and industrial property.

The Ministry partially denied access, on the understanding that there is information not accessible to individuals or associations, because it harms economic and commercial interests.

When the complaint was filed, the Council of Transparency and Good Government considered it for formal reasons, urging the Ministry to send the request for access to the Spanish Agency for Medicines. It also fully estimated it as regards the request for prescription statistics and the annual cost of medicines.
