The Free Union of Pharmacists of the Valencian Community submitted a request for access to information addressed to the National Commission of Markets and Competition (CNMC) to access the content of the sanctioning file already completed, on the supply of test strips, for violation of the competition regulations.

The CNMC denied access, on the understanding that the applicant, although it was the complainant, was not interested in this file.

When a complaint was filed, the Council for Transparency and Good Governance rejected it, since all the information or documentation obtained by the CNMC as a result of its inspection work enjoys the status of information reserved by express legal mandate.
