A Community of Irrigators submitted a request for access to information addressed to the State Mercantile Society of Agrarian Infrastructures (SEIASA) to access the reports of the State Attorney in relation to the effects of the sentence imposed on SEIASA by an arbitral award, in 2009.

SEIASA did not provide the information on the understanding that they were auxiliary or supporting documents, in application of the cause of inadmissibility of article 18.1 (b) of the transparency law.

The Council for Transparency and Good Governance considered the complaint in part, since a State Attorney ' s Report that subsequently serves as a basis for a final decision or resolution of the Administration and that has an impact on the rights and obligations of affected third parties cannot be considered, in the opinion of the Council, to be auxiliary or supportive.
