103. Office of Conflict of Interest. Failure to comply with the Senior Officials Act
SUMMARY
A citizen submitted a request for access to information addressed to the Office of Conflicts of Interest to know the list of senior officials who have not fulfilled the obligations provided in the High Office Regulatory Law of 2015, regarding their declarations of assets and interests.
The administration provided information regarding two sanctions to two senior officials, which was considered insufficient by the applicant.
When the complaint was filed, the Transparency and Good Governance Council considered that the information provided did not cover all aspects of the access request and an integrated version of the Senior Officials Compliance Report should be provided.
The judgment on appeal corrects the judgment in the first instance and gives the Transparency Council reason. Therefore, the Ministry will have to provide the information.
