115. Minutes and agreements of the Board of Directors of the Port Authority of A Coruña
SUMMARY
A citizen presented a letter addressed to the Port Authority of A Coruña requesting access to minutes and meeting agreements of its Board of Directors in the period 2015-2018.
The Administration denied the information because it understood that the request affects confidentiality and secrecy in decision-making, national security and public security, equality of the parties in judicial processes, surveillance and control, their economic and commercial interests and the protection of personal data.
When the complaint was filed, the Transparency Council considered it, considering that the alleged confidentiality of meetings and deliberations whose public knowledge serves to respond to the citizens, as established by the Law, cannot be prejudiced. Nor have the other limits referred to been justified, since the Administration has merely invoked them.
Finally, the limit of data protection is not applied, since the components of the Board of Directors are governing bodies that make the decisions of the Agency, prevailing the right of access to information, according to the established criterion of the Transparency Council in this matter.
