91. Ministry of Development. Register of Railway Bridge Inspections
SUMMARY
A citizen submitted a request for access, addressed to the Ministry of Development, to know the specific content of the Register of Inspections of Railway Bridges.
The Ministry denied the information on the grounds that it would violate public security and the administrative functions of monitoring, inspection and control.
The Council for Transparency and Good Governance, after analysing both limits extensively, considered that, despite referring to critical infrastructures, there are not sufficient factual budgets to understand the application of the harm to public security. Although access to this Register is reserved, according to the Council, the public interest in knowing this information prevails. Similarly, there is no harm to the Ministry ' s administrative functions of monitoring, inspection and control, since the information requested relates to past inspections, which do not interfere with present or future inspections, nor has the Ministry sufficiently justified the actual danger or harm invoked.
