SUMMARY

A citizen submitted a request for access to the information addressed to the Port Authority of Gijón to access the copies of the orders of the day, minutes and resolutions approved by each board of directors held at the Port Authority of Gijón, between 1996 and 2017.

The Administration denied the information, citing the limits relating to national security, public security, equality in judicial processes and protection of personal data.

When the complaint was filed, the Council of Transparency and Good Governance considered that the limits invoked were not applicable, based on the interpretation that the courts of justice make of them. There are also precedents in which requests for information on minutes and orders of the day are estimated. It also does not affect the protection of personal data, since the identifying data refers to persons holding managerial positions.
