A citizen submitted a request for access to information, addressed to the National Securities Market Commission (CNMV) to have access to the sanctioning file for very serious infringement.
The CNMV denied the request for affecting the protection of personal data and for there being a specific procedure for access to information in the Securities Market Law.
When the complaint was filed, the Transparency and Good Governance Council considered it on formal grounds, given that the CNVM has omitted the process of hearing affected third parties required by Article 19.3 of Law 19/2013, of 9 December (LTAIBG). Consequently, proceedings are brought back for the CNMV to carry out the mandatory hearing procedure.
