137. Examinations Opposition of the State Civil Administration Management Corps
SUMMARY
A citizen submitted a request for access to information addressed to the Ministry of Territorial Policy and Public Service to obtain the written exercises of other fellow opponents of the State Civil Administration Management Corps.
The Administration denied the application because it considered that the applicant was interested in an ongoing administrative procedure, not applying the Transparency Act, but the opposition’s own procedure, as stated in the First Additional Provision of the Act.
When the complaint was filed, the Council of Transparency and Good Governance considered it, since its own administrative procedure has already been completed, not applying the aforementioned First Additional Provision, but the Transparency Act. There is, in this case, competitive competition, so access to information prevails over the protection of personal data of other opponents.
