SUMMARY

A citizen submitted a request for access to information addressed to Renfe Operadora, of the Ministry of Public Works, to have access to the tender for travel services in local services between several Catalan localities.

Renfe Operadora denied the request because the claimant is an interested party in the procedure it intends to access, which is still in progress, which is governed by its own access regulations and because the request is abusive.

The Council of Transparency and Good Government partially considered the complaint, since it is not appreciated that there is a specific access procedure outside of Law 19/2013, of December 9, on transparency, access to public information and good governance (TAIBG), nor is it understood that it is abusive, being able to access its content, being a contract that must be published by legal mandate, eliminating that information that could affect technical or commercial secrets.
