147. Denial of access to the Labour Inspectorate’s infringement proceedings
SUMMARY
A citizen submitted a request for access to information addressed to the Ministry of Labour, Migration and Social Security in order to have access to the contents of the records of violations, the reports of the acting inspector and a copy of the files opened to obtain evidence to be presented to the Ombudsman and the courts of justice.
The Ministry did not respond to this request.
When a complaint was filed, the Council of Transparency and Good Government rejected it because it was an application that does not fit the purpose of the LTAIBG, since it does not seek control of public activity, but rather the resolution of a private conflict within the labor sphere.
