SUMMARY

A private foundation submitted a request for access to information addressed to the Ministry of Justice to have access to the identification and professional data of temporary workers of the Ministry during the year 2018.

The Ministry did not respond to this request .

The Council of Transparency and Good Governance partially considered the complaint, since, having made the weighting required by law between the right to data protection and the right of access to information, the latter must prevail in those cases of data of workers who hold managerial positions or positions of responsibility in decision-making, leaving aside those others who do not hold these positions of responsibility: levels below 28.
