155. Denial of access to reports of deaths in Alien Detention Centers
SUMMARY
A citizen submitted a request for access to information addressed to the Ministry of the Interior with the aim of obtaining the information.nformes forenses, policiales o médicos sobre fallecimientos en varios Centros de Internamiento de Extranjeros.
The Ministry of the Interior denied the information on the grounds that it was abusive and that it could jeopardize the prevention, investigation and punishment of criminal offences, since it would reveal protocols of action where human and material resources are combined, jeopardizing the proper development of police operations.
When the complaint was filed, the Council of Transparency and Good Governance considered it. According to the Council, the alleged damages are not appreciated nor can the request made be understood as abusive, which fits the purpose pursued by the Transparency Law of controlling public performance.
