SUMMARY
A citizen submitted a request for access to information addressed to the Ministry of Defense to obtain information on the content of the knowledge tests carried out in 2018 for the access of the military of complement and of troop and sailor to a permanent service relationship.
The Ministry of Defence denied the information on the grounds that it was abusive.
The Council of Transparency and Good Governance, having filed a complaint, considered it not to be abusive, but to be in accordance with the purpose pursued by the Law.
Subsequently, the Ministry presented to the Transparency Council a letter of withdrawal of the claimant, so a new resolution was issued in which it was agreed to revoke the first resolution and decree the filing of proceedings.
Finally, the Central Court of Administrative Litigation No. 11 of Madrid issued an Order declaring the proceedings to have been completed because of the extra-procedural satisfaction of the claim.
