168. Presidency of the Government. Appointment, cessation and remuneration of temporary staff
SUMMARY
A private foundation submitted a request for access to information addressed to the Presidency of the Government to have access to the data of: name, position, date of appointment, date of termination and annual remuneration of temporary workers who have served in all ministries and in the Presidency of the Government during 2016, in reusable formats.
The Presidency of the Government did not respond to this request.
The Council of Transparency and Good Governance partially considered the complaint, establishing the criteria for access to this information: remuneration and other information on contingent personnel must be given from the 28 levels of free appointment because their appointment and appointment are based on reasons of advice and special confidence, but not with respect to personnel below the 28 level, since, although they are also appointed for reasons of special confidence, they do not perform advisory functions.
Likewise, the data protection regulations are not violated, since the right of access to public information prevails.
