SUMMARY

A citizen submitted a request for access to information addressed to the Labour and Social Security Inspectorate of the Ministry of Labour, Migration and Social Security, to obtain a copy of all the inspection minutes and the sanctioning files to Castilla-La Mancha TV, without specifying the time period to which the request refers.

The Administration rejected the request because there is a specific access procedure to the information contained in the Ordinating Law on the Labour and Social Security Inspection System, the application of Additional Provision First, paragraph 2, of the transparency law.

When a complaint was filed, the Transparency and Good Governance Council partially considered it, since the regulations invoked do not contain a true procedure for access to information and because the right of access to inspection records must be allowed by eliminating those parties that are affected by confidentiality on the economic and commercial interests of the companies investigated. The minutes that are in the process of being prepared should also be omitted. All of this, since the entry into force of the transparency law.
