RCA177. Ministry of Health, Consumption and Social Welfare. Reports and minutes of the Interministerial Committee on Drug Pricing
SUMMARY
A citizen submitted a request for access to information addressed to the Ministry of Health, Consumption and Social Welfare to access negotiations to fix the maximum price of each authorized drug, with information disaggregated by each drug in which the objective criteria that have been followed to mark the price of each of them can be known.
The Ministry denied the information because it considered that it contained data and information protected by the guarantee of confidentiality and whose disclosure could affect the economic and commercial interests of the laboratories holding the medicines to which they refer.
Once a complaint has been filed, the Transparency and Good Government Council partially considered it since, although the information has to be given, classified or other matters whose dissemination is legally prohibited must be excluded, in the weighted and loyal criteria of the Administration. Likewise, the data that affects natural persons named in the records that are not public officials with decision-making capacity must be eliminated, provided that they are identified in the requested documentation.
