SUMMARY

A citizen submitted a request for access to information addressed to the Ministry of Public Works with the aim of knowing information about the non-agreement personnel of the Port Authority of Santa Cruz de Tenerife, including their salaries, functions and qualifications.

In its response, the Port Authority partially provided the requested information and considered the request abusive within the meaning of art. 18.1 (e) of the Transparency Act, as well as which may prejudice the equality of the parties in judicial proceedings and effective judicial protection (art. 14.1 (f)).

When the complaint was filed, the Council for Transparency and Good Governance partially considered it on the understanding that there was no open judicial procedure that could be prejudiced with access and that the exercise of the right of access could not be limited quantitatively: even if the applicant had requested a lot of information, it could not be described as abuse.
