RCA193. Ministry of Justice. Documentation on the Fundación Alternativas
SUMMARY
A citizen submitted a request for information interested in documentation relating to a Foundation registered in the Register of Foundations, specifically the Fundación Alternativas. Among the information requested was the annual accounts, the founding minutes and a history of members of the Board.
After a period of one month to resolve the case without a response, the petitioner filed a complaint with the Council for Transparency and Good Governance, in which the Ministry of Justice considered that access to the requested information was regulated by a specific regulation and that the published information could only be accessed through a link to which the petitioner was sent, where not all the required documentation was found.
In its resolution, the Transparency Council understands that the regulation of the Registry of Foundations is not a specific regulation on access and that the Transparency Law is fully applicable.
