SUMMARY

One company submitted a request for access to the Ministry of Agriculture, Fisheries and Food to obtain access to the documents contained in certain sanctioning files filed with fishing companies in the tuna sector and also to all those communications that the Spanish State has made to the European Union to inform it of the existence of such sanctions.

The Administration did not respond to the request for access.

Once a complaint has been filed, the Transparency and Good Government Council partially considered it, considering that, although in this case it is not known that a sanction file had been initiated and resolved against the companies mentioned by the applicant, the estimate of this section of the complaint must refer to those files that, if applicable, would have ended up giving access only to the sanctioning resolution that had been issued, without affecting other rights and equally legitimate interests.
