SUMMARY

A citizen submitted a request for access to information to the RTVE Corporation to know the Reasons for hiring a certain presenter and his cache, in the programs: "Blood Ties" and "Prodigies". Also, the cost of the programs was requested.

RTVE did not respond to the request.

When the complaint was filed, the Council of Transparency and Good Governance considered it, since the production costs include those of the presenter’s remuneration, which is related to public resources, so that the request falls within the scope of application of the Law. It is understood, in contrast to the criterion stated above, that the right to data protection cannot prevail over the public interest in the disclosure of information (Judgment 3/2019, of January 25, 2019 dell Central Court of Administrative Litigation No. 7 of Madrid).
