SUMMARY

One company submitted a request for access to information addressed to the Ministry of Public Works to find out specific aspects of the file on forced expropriation of farms by the construction of certain toll roads.

The Ministry denied the information stating that it is currently carrying out the calculations to determine the so-called Patrimonial Responsibility of the Administration (RPA), a fundamental element of this liquidation process.

When a complaint was filed, the Council of Transparency and Good Governance rejected it, since the information now requested is part of an ongoing administrative procedure and, consequently, access to the documentation contained in a file by the interested party would be applicable and regulated in the Law 39/2015, of 1 October, on the Common Administrative Procedure of Public Administrations.
