SUMMARY

The application was intended to access the minutes of the General Board and the Assembly of the Florida Canal Irrigant Community of Liébana. The applicant raised certain issues which, in his opinion, were infringements of the law in force.

In the absence of a response, the applicant lodged a complaint with the Council for Transparency and Good Governance, in the course of which submissions were received from the said Community of Irrigators showing that the person concerned had presided over the Community and had been made aware of the documentation now requested.

In its resolution, the Council of Transparency and Good Governance analyzed that one of the requested acts had disappeared, as reported by the Community of Regants and another had been prepared by a third entity and had been contributed to the Community of Regants when the applicant presided over it. In those circumstances, it was concluded that the information requested was already known to the person concerned and that, as a result, the grounds for the claim could not be satisfied.
