SUMMARY
Claim against denial of access to a copy of all complaints received by the trade unions.
The company RYANAIR filed a request for access with the Ministry of Labor and Social Economy, requesting information on all complaints received by the unions USO and SITCPLA regarding the existence of illegal assignment of workers between the Company and the subcontracted companies CREWLINK IRELAND LIMITED (“CREWLINK”) workforce and INTERNATIONAL CONTRACTORS (“WORKFORCE”). The Administration denied access due to administrative silence. When a complaint was filed, the Council of Transparency and Good Government considered it, since it is not considered that providing the requested information could lead to undue and unlawful limitation of the right of trade union action of the trade unions USO and SITCPLA, which could lead to an injury to the constitutional right contained in article 28.1 of the Constitution, nor is the existence of the limits relating to the breach of the duty of confidentiality of the labour inspectors or the duty of secrecy recognized.
