SUMMARY

Claim against partial denial of access to the Information on the feasibility study of the railway connection of the Punta Llagostera External Port and report of the Regional Intervention.

A citizen presented a letter to the Port Authority of A Coruña, of the Ministry of Transport, Mobility and Urban Agenda, requesting access to the feasibility study of the railway connection of the Punta Llagostera External Port, the minutes of the sessions and the report of the Regional Intervention.

The Administration denied access due to administrative silence.

The Council of Transparency and Good Governance partially estimated the complaint, given that a) what is requested is an economic feasibility report presented to State Ports, updating the one made in 2018, within the framework of the project of construction of the aforementioned railway connection and is finished, not in the elaboration phase; b) in terms of the minutes, they have not been prepared by the Port Authority of A Coruña but by State Ports. Since the former has submitted the request for access to the latter body, it acts in accordance with Article 19.4 of the LTAIBG, rejecting the claim at this point; and c) with respect to the report of the Regional Intervention, this is public information held by the Port Authority of A Coruña and must be delivered.
