A shipping company submitted a request for information to the Port Authority of Alicante, of the Ministry of Transport, Mobility and Urban Agenda, to know certain aspects of the concession of a freight terminal dedicated to particular use by the Port Authority of Alicante in favor of JSV LOGISTIC, SL and FJ Naranjo González.

The Administration denied access due to administrative silence.

Once a complaint has been filed, the Council of Transparency and Good Government partially considered it, since part of the request is pending in a judicial proceeding (since the initial denial and subsequent dismissal of the appeal have been appealed) and the parallel opening of another channel of review or guarantee is not appropriate and the other requested party has the status of public information and the Port Authority has not justified that it does not have such information, nor that any of the limits provided in Articles 14 and 15 of the LTAIBG apply, or that there is some cause for inadmissibility of those provided in Article 18 of the LTAIBG.
