In exercise of its right of access to information, the Community of Irrigators Arco Sur Mar Menor submitted a letter to the Ministry for Ecological Transition and the Democratic Challenge, requesting the existing documents regarding the appointment and inauguration of the president and water commissioner of the Hydrographic Confederation of Segura, an autonomous body attached to the aforementioned Ministry.
Initially, the agency granted access by merely referring to appointments, both provisional and definitive, and the latter with an indication of the date of publication in the Official State Gazette. When a claim was filed, the Confederation supplemented the information requested, without the requesting entity objecting to the hearing procedure granted to it.
In its resolution, the Council for Transparency and Good Governance considers the claim on formal grounds, on the understanding that the Ministry, albeit belatedly, has provided the information at its disposal without any objection having been received, but, on the other hand, also recognizing the right of the interested party to obtain a resolution within the established time limit, which has not happened in this case, in which the community of irrigators has been forced to submit a claim to the Council in order to see their right fully recognized.
