In exercise of the right of access to public information, a request for access to the name of the author or authors of a CIS survey was submitted to the Ministry of the Presidency, Justice and Relations with the Courts.
The CIS decided that the author of the questionnaire of questions and answers of the reference study is the institution itself, specifying that the studies it carries out are elaborated in collaboration by the entire team of researchers of the organism, so it could not identify a single author or list of authors.
Subsequently, in the processing of claims filed in the complaint procedure, it considers the limit provided for in Article 15.2 LTAIBG to be applicable, so it concludes by maintaining that the identification of the name of the public employees that constitute the CIS investigator team is not relevant to the public interest that might be aroused by the knowledge of identifying data of the investigator team.
The Board considers that the complaint is not supported by the CIS for any reason that could justify the denial of access to the identity of the author or authors of the reference survey. Thus, there is no reasoning or explanation of the reasons why, exceptionally, the identity of any of those affected should be preserved against the general principle of publicity contemplated in the aforementioned article 15.2 LTAIBG.
