In exercise of the right of access to public information, the GUADALQUIVIR HYDROGRAPHIC CONFEDERATION/MINISTRY FOR ECOLOGICAL TRANSITION AND DEMOGRAPHIC CHALLENGE was asked for various information on the hectares expropriated by the Ministry of Ecological Transition from 2014 to 2024 for the realization of public works, broken down by years and autonomous community.

The requested ministry issued an inadmissible ruling on the grounds that the inadmissibility of Article 18(1)(c) LTAIBG was applicable, alleging that it was information “for whose disclosure a prior action of mass data reprocessing is necessary”.

The Council considers the complaint against the total refusal of the requested information, which is of a public nature and which must be recorded in the department responsible for monitoring the expropriation files involved, without sufficient justification having been provided for the reasons underlying this decision. It also takes into account the fact that this information has already been provided by other confederations. Consequently, it is urged that, after weighing up the interests of third parties that may be affected, in respect of which nothing has been said by the Administration and in accordance with the provisions of Article 15.3 LTAIBG, access to the request is facilitated.
