In exercise of the right of access to public information, the MINISTRY OF FINANCE was requested access to the State’s six-monthly territorialized investment reports from the second half of 2022 to the first half of 2024, both included, specifying certain data.
The Ministry responds by providing the link to the portal of the Budgetary Administration which includes information on budgetary execution of the State public sector.
The Claimant underlines that it has been provided with a link to a web page with outdated information, which does not contain the required periods (2022-2024) and does not provide answers regarding specific questions about distribution criteria and reasons for non-publication.
At the allegation stage of this procedure, the Ministry indicates that it responded in accordance with the provisions of article 8.1.d) LTAIBG, referring to the economic, budgetary and statistical information that it is obliged to provide in accordance with the provisions for active publicity.
The Council partially estimates the claim. It considers that the Ministry has not denied that the information is in its possession; nor has it alleged the concurrence of any legal cause (of those provided in Articles 14 and 18 LTAIBG) to justify the non-delivery of the requested information, nor has it considered informing about the approximate date of publication of these contents, so it is appropriate to estimate the claim, except in relation to the explanation of the reason why the execution of the investment of the State Public Sector is not published every six months, since such issues have no place in the notion of information established in Article 13 LTAIBG.
