Resolution appealed: R CTBG 1371/2024
In exercise of the right of access to public information, the MINISTRY OF INDUSTRY AND TOURISM was requested to access various information related to the Parador de Turismo de Baiona.
The requested ministry issued a resolution providing partial access to the requested information on the grounds, as a reason for not providing the rest of the documentation, that it was not available.
Only, with respect to the inventory of movable and artistic property to which the application refers, denies access to it in application of the provisions of article 14 LTAIBG, paragraphs (e), (g) and (h), without providing any justification or argumentation to support this decision.
The Council in resolving this claim, in relation to the point referred to the aforementioned inventory, refers to a previous estimatory resolution R/0493/2017 issued in relation to the Parador Hostal de San Marcos of the city of León, in which it was stated that “the mere indication of the name or title of the work and its characteristics – eliminating any reference to its current physical or geographical location – would not facilitate its theft or put at risk the Spanish historical-artistic heritage” and, consequently, “drawing up an inventory of movable assets of cultural heritage not only does not put at risk those assets, but is considered a measure to strengthen its security”.
Accordingly, it concludes by partially estimating the claim filed on this occasion, urging the MINISTRY OF INDUSTRY AND TOURISM to provide the claimant with an inventory of the movable and artistic property existing in the Parador de Baiona, without including its exact physical location.
