161. Reports of the State Legal Profession within a Regulatory Development Dossier
SUMMARY
One company filed a request for access to information addressed to the Ministry of Justice to obtain the reports prepared by the State Attorney within a dossier of elaboration of regulations on reforms in the field of infrastructure, transport and other economic measures.
The Ministry of Justice denied the requested information on the grounds that it was prior to the entry into force of the Transparency Act.
When the complaint was filed, the Council of Transparency and Good Governance considered it. The Council argues that it follows from the content of the Law that it applies to any information or documentation held by the Administration at the time it is requested, regardless of its date of elaboration, although the right to request information arises from the moment of the entry into force of the rule (December 10, 2014).
