164. Powers of the Ministry of Foreign Affairs, European Union and Cooperation in civil and commercial matters
SUMMARY
A citizen submitted a request for access to information addressed to the Ministry of Foreign Affairs, European Union and Cooperation to obtain the data relating to the jurisdiction and the recognition and enforcement of judgments in civil and commercial mattersbased on Article 60 of European Regulation 1215/2012 Regulation (EU) 1215/2012 of 12 December.
The Ministry denied the information on the grounds that it is not subject to the scope of application of the Transparency Act.
When a complaint was filed, the Council for Transparency and Good Governance considered it, since article 6 of the Transparency Act requires the provision of information ex officio on the regulations that apply to each subject bound by the Act. In addition, there is a precedent in which the Transparency Council urged the Ministry to provide this same information, without any record of compliance.
