SUMMARY

Application for the right of access addressed to the City of Gijón, in order to know certain information on the reasons why the celebration of the II Solidarity Race for the Disability of Asturias was not authorized.

After the legally established period has elapsed without having obtained a response to his request, the interested party understands it rejected by administrative silence and brings a claim under article 24 of the LTAIBG on 8 August 2017.

The Council of Transparency and Good Governance does not accept the complaint filed because it considers that there is no request for access to public information, understood in the terms of article 13 of the LTAIBG, nor an express or presumed act of the administration that denies access to the public information requested to implement the complaint under article 24 of the LTAIBG.

Faced with this resolution, the interested party lodges an administrative appeal in October 2018.
