SUMMARY

Corrientes Sindical d’Izquierdo del Principado de Asturias filed a complaint with this Council under Article 24 of the LTAIBG against the Resolution of the Managing Director of the Health Infrastructure Management Entity of the Principality of Asturias, SAU (GISPASA), partially estimating a prior request for access to information in relation to the execution of a contract for waste management, pest control service and cleaning and conservation of roads and gardens for the new Central University Hospital of Asturias awarded to a mercantile.

The Council of Transparency and Good Governance, taking as the basis of its decision the content of the joint criterion developed with the Spanish Data Protection Agency on the scope and content of article 15 of the LTAIBG, dismisses the Claim raised by application of the provisions of article 15.3 of the LTAIBG.

In the face of this Council Resolution, a contentious-administrative appeal is filed by Corrientes Sindical d’Izquierdo.

The Central Administrative Court No. 10 of Madrid dismisses the appeal filed by judgment of September 7, 2018.
