SUMMARY

Application for right of access addressed to the City of Carreño, in order to know certain information about the contract made for the works of a road, together with its payment invoices, which has been financed with part of the Compensation Fund of COGERSA (Consortium for the Management of Solid Waste of Asturias).

After the legally established deadline without having obtained a response to your request, the interested party understands it dismissed by administrative silence and filed on May 31, 2018 a claim under article 24 of the LTAIBG.

During the processing of the file, the information was made available to the claimant so that the claim was estimated for formal reasons, without the Municipality of Carreño having to take any action in this regard.

Faced with this resolution, the City of Carreño filed a contentious-administrative appeal in January 2019, considering that the claim should have been rejected instead of estimated for formal reasons, since the requested documentation has been made available to the claimant. It also expresses its disagreement with the statement made in the Council resolution in this regard that the notification to the interested party had been made incorrectly by the City Council.
