A citizen sends an application for the right of access to public information to the University of Castilla-La Mancha (UCLM), according to which he is interested in the items of UCLM expenses destined to sponsorships of sports entities or clubs from 2012 to 2018, broken down by amount of money, date, receiving club and duration of the agreement. Being dissatisfied with the response given to his request, the interested party presents a complaint to the Council of Transparency and Good Governance (CTBG) on February 18, 2019.
The UCLM provides the interested party with the information in global terms, without the detail requested by him, arguing that breaking down the figure of expenses would harm the economic and commercial interests of the UCLM, in accordance with the provisions of articles 14.1.h) of Law 19/2013, of 9 December, on transparency, access to public information and good governance, and in article 25 of Law 4/2016, of 15 December, on transparency and good governance of Castilla-La Mancha.
The CTBG estimates the claim raised since it considers that the UCLM limits itself to stating that the provision of the information affects its economic and commercial interests, without providing further arguments to justify such assertion and without stating that the damage and public interest test required by Law 19/2013, of 9 December, has been carried out when taking into account the limits established in its articles 14 and 15.
Dissatisfied with the resolution issued by the UCLM interposes contentious-administrative appeal that has entry into the Council on July 29, 2019.
